Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites,
AI-powered virtual assistants ("AI Employees"), and related services (together, the
"Service") provided by Hyventa ("we", "us", "our"). By creating an account, starting
a free trial, or using the Service, you agree to these Terms. If you do not agree, do not
use the Service.

2. The Service
Hyventa provides configurable AI assistants that businesses embed on their websites and
messaging channels to handle sales, reception, support, recruiting, and similar tasks.
Features, capabilities, and included "skills" depend on the plan you select.
3. Free trial
- - We offer a 7-day free trial to new customers.
- - No charge is made during the trial. Unless you cancel before the trial ends, your
selected plan begins and the first billing cycle is charged automatically.
- - We may limit or withdraw trial eligibility to prevent abuse (e.g. repeated sign-ups).
4. Plans, billing & renewal
- - Paid plans are billed on a recurring basis (monthly or as stated at checkout), plus any
one-time setup fee shown for your plan.
- - Subscriptions renew automatically at the end of each billing cycle until cancelled.
- - Prices may change; we will give reasonable advance notice before a change affects you.
- - Taxes may apply depending on your location.
5. Cancellation
You may cancel at any time from your account or by emailing [email protected]. Cancellation
stops the next renewal; the Service remains active until the end of the current paid period.

6. Acceptable use
You agree not to:
- - use the Service for unlawful, fraudulent, harmful, or deceptive purposes;
- - send spam, malware, or attempt to breach security or access other users' data;
- - use the AI Employees to generate illegal content, harass, or violate others' rights;
- - misrepresent an AI Employee as a human where the law requires disclosure;
- - resell or sublicense the Service without our written permission.
You are responsible for the content and data you and your end-users submit.
7. AI-generated content & disclaimer
AI Employees produce automated responses that may contain errors or inaccuracies. The
Service is provided for business automation and does not constitute legal, medical,
financial, or other professional advice. You are responsible for reviewing outputs before
relying on them, especially for important decisions.
8. Your data
Our handling of personal data is described in our Privacy Policy. For personal data your
end-users submit to an AI Employee, you are the Data Controller and Hyventa acts as your
Data Processor.
9. Intellectual property
We (and our licensors) retain all rights in the Service, software, and branding. You retain
rights in your own content and data. We grant you a limited, non-exclusive, non-transferable
right to use the Service during your subscription.
10. Availability & support
We aim for high availability but do not guarantee uninterrupted, error-free operation.
Maintenance, third-party outages (e.g. AI providers), or force majeure may cause downtime.
11. Limitation of liability
To the maximum extent permitted by law, Hyventa is not liable for indirect, incidental, or
consequential damages, or for lost profits or data. Our total liability for any claim is
limited to the amount you paid for the Service in the 3 months before the event giving rise
to the claim.
12. Termination
We may suspend or terminate your access if you breach these Terms or use the Service in a way
that risks harm to us, other users, or third parties. You may stop using the Service at any
time.
13. Changes to these Terms
We may update these Terms; the "Last updated" date reflects the latest version. Material
changes will be communicated where reasonable. Continued use after changes means you accept
them.
14. Governing law
These Terms are governed by the laws of Ukraine, unless mandatory consumer-protection law of
your country of residence applies.

Estos Términos del Servicio ("Términos") regulan tu acceso y uso de los sitios web, los
asistentes virtuales con IA ("Empleados IA") y los servicios relacionados (en conjunto, el
"Servicio") que ofrece Hyventa ("nosotros"). Al crear una cuenta, iniciar una prueba
gratuita o usar el Servicio, aceptas estos Términos. Si no estás de acuerdo, no uses el
Servicio.

2. El Servicio
Hyventa ofrece asistentes de IA configurables que las empresas integran en sus sitios web y
canales de mensajería para gestionar ventas, recepción, soporte, selección de personal y
tareas similares. Las funciones y las "habilidades" incluidas dependen del plan elegido.
3. Prueba gratuita
- - Ofrecemos una prueba gratuita de 7 días a nuevos clientes.
- - No se cobra nada durante la prueba. Salvo que canceles antes de que termine, tu plan
comienza y el primer ciclo de facturación se cobra automáticamente.
- - Podemos limitar o retirar la elegibilidad para la prueba a fin de evitar abusos.
4. Planes, facturación y renovación
- - Los planes de pago se facturan de forma recurrente (mensual o según se indique al pagar),
más cualquier cuota única de configuración que corresponda a tu plan.
- - Las suscripciones se renuevan automáticamente al final de cada ciclo hasta que se
cancelen.
- - Los precios pueden cambiar; avisaremos con antelación razonable antes de que un cambio te
afecte.
- - Pueden aplicarse impuestos según tu ubicación.
5. Cancelación
Puedes cancelar en cualquier momento desde tu cuenta o escribiendo a [email protected]. La
cancelación detiene la siguiente renovación; el Servicio sigue activo hasta el final del
período pagado en curso. Consulta la Política de Reembolsos para más detalles.
6. Uso aceptable
Aceptas no:
- - usar el Servicio con fines ilícitos, fraudulentos, dañinos o engañosos;
- - enviar spam o malware, ni intentar vulnerar la seguridad o acceder a datos de otros;
- - usar los Empleados IA para generar contenido ilegal, acosar o vulnerar derechos ajenos;
- - presentar un Empleado IA como humano cuando la ley exija su divulgación;
- - revender o sublicenciar el Servicio sin nuestro permiso por escrito.
Eres responsable del contenido y los datos que tú y tus usuarios finales envíen.
7. Contenido generado por IA y descargo de responsabilidad
Los Empleados IA producen respuestas automáticas que **pueden contener errores o
inexactitudes**. El Servicio se ofrece para la automatización empresarial y no constituye
asesoramiento legal, médico, financiero ni de otro tipo profesional. Eres responsable de
revisar los resultados antes de confiar en ellos, en especial para decisiones importantes.
8. Tus datos
El tratamiento de datos personales se describe en nuestra Política de Privacidad. Respecto a
los datos personales que tus usuarios finales envíen a un Empleado IA, tú eres el Responsable
del tratamiento y Hyventa actúa como Encargado.
9. Propiedad intelectual
Nosotros (y nuestros licenciantes) conservamos todos los derechos sobre el Servicio, el
software y la marca. Tú conservas los derechos sobre tu propio contenido y datos. Te
concedemos un derecho limitado, no exclusivo e intransferible de uso durante tu suscripción.
10. Disponibilidad y soporte
Aspiramos a una alta disponibilidad, pero no garantizamos un funcionamiento ininterrumpido ni
libre de errores. El mantenimiento, las caídas de terceros (p. ej. proveedores de IA) o la
fuerza mayor pueden causar interrupciones.
11. Limitación de responsabilidad
En la máxima medida permitida por la ley, Hyventa no responde por daños indirectos,
incidentales o consecuentes, ni por lucro cesante o pérdida de datos. Nuestra responsabilidad
total por cualquier reclamación se limita al importe que hayas pagado por el Servicio en los
3 meses anteriores al hecho que la origina.
12. Terminación
Podemos suspender o terminar tu acceso si incumples estos Términos o usas el Servicio de un
modo que ponga en riesgo a nosotros, a otros usuarios o a terceros. Puedes dejar de usar el
Servicio en cualquier momento.
13. Cambios en estos Términos
Podemos actualizar estos Términos; la fecha de "Última actualización" refleja la versión
vigente. Los cambios importantes se comunicarán cuando sea razonable. El uso continuado tras
los cambios implica su aceptación.
14. Ley aplicable
Estos Términos se rigen por las leyes de Ucrania, salvo que se aplique la legislación
imperativa de protección al consumidor de tu país de residencia.

Ці Умови надання послуг («Умови») регулюють ваш доступ і користування сайтами,
віртуальними помічниками на основі ШІ («ШІ-співробітники») та пов'язаними послугами (разом —
«Сервіс»), які надає Hyventa («ми»). Створюючи обліковий запис, розпочинаючи безкоштовний
пробний період або користуючись Сервісом, ви погоджуєтеся з цими Умовами. Якщо ви не згодні —
не користуйтеся Сервісом.

2. Сервіс
Hyventa надає налаштовуваних ШІ-помічників, яких компанії вбудовують на свої сайти та в
канали зв'язку для продажів, ресепшену, підтримки, підбору персоналу та подібних завдань.
Функції та включені «навички» залежать від обраного тарифу.
3. Безкоштовний пробний період
- - Ми пропонуємо новим клієнтам 7-денний безкоштовний пробний період.
- - Під час пробного періоду плата не стягується. Якщо ви не скасуєте до його завершення, ваш
тариф активується, і перший розрахунковий цикл списується автоматично.
- - Ми можемо обмежувати або скасовувати право на пробний період для запобігання зловживанням.
4. Тарифи, оплата та поновлення
- - Платні тарифи оплачуються на регулярній основі (щомісяця або як зазначено під час
оформлення), плюс одноразова плата за налаштування, якщо передбачена тарифом.
- - Підписки поновлюються автоматично наприкінці кожного циклу до моменту скасування.
- - Ціни можуть змінюватися; ми повідомимо заздалегідь у розумний строк до того, як зміна вас
торкнеться.
- - Залежно від вашого місцезнаходження можуть застосовуватися податки.
5. Скасування
Ви можете скасувати будь-коли з облікового запису або листом на [email protected].
Скасування зупиняє наступне поновлення; Сервіс залишається активним до кінця оплаченого
періоду. Деталі щодо повернень — у Політиці повернень.
6. Прийнятне використання
Ви погоджуєтеся не:
- - використовувати Сервіс у незаконних, шахрайських, шкідливих чи оманливих цілях;
- - надсилати спам, шкідливе ПЗ або намагатися зламати захист чи отримати доступ до чужих даних;
- - використовувати ШІ-співробітників для незаконного контенту, домагань чи порушення прав інших;
- - видавати ШІ-співробітника за людину там, де закон вимагає розкриття;
- - перепродавати чи субліцензувати Сервіс без нашого письмового дозволу.
Ви відповідаєте за контент і дані, які ви та ваші кінцеві користувачі надсилаєте.
7. Контент, згенерований ШІ, та застереження
ШІ-співробітники надають автоматичні відповіді, які **можуть містити помилки або
неточності**. Сервіс надається для автоматизації бізнесу і не є юридичною, медичною,
фінансовою чи іншою професійною консультацією. Ви відповідаєте за перевірку результатів,
перш ніж покладатися на них, особливо у важливих рішеннях.
8. Ваші дані
Обробка персональних даних описана в нашій Політиці конфіденційності. Щодо персональних
даних, які ваші кінцеві користувачі надсилають ШІ-співробітнику, ви є Володільцем даних, а
Hyventa виступає Обробником.
9. Інтелектуальна власність
Ми (та наші ліцензіари) зберігаємо всі права на Сервіс, ПЗ і бренд. Ви зберігаєте права на
власний контент і дані. Ми надаємо вам обмежене, невиключне право користування Сервісом на
час підписки.
10. Доступність і підтримка
Ми прагнемо високої доступності, але не гарантуємо безперебійної роботи без помилок.
Технічне обслуговування, збої третіх сторін (напр. постачальників ШІ) або форс-мажор можуть
спричинити простій.
11. Обмеження відповідальності
У максимально дозволеному законом обсязі Hyventa не відповідає за непрямі, випадкові чи
побічні збитки, а також за втрачений прибуток чи дані. Наша сукупна відповідальність за
будь-якою вимогою обмежується сумою, яку ви сплатили за Сервіс за 3 місяці до події, що
спричинила вимогу.
12. Припинення
Ми можемо призупинити або припинити ваш доступ у разі порушення цих Умов або використання
Сервісу в спосіб, що загрожує нам, іншим користувачам чи третім сторонам. Ви можете
припинити користування Сервісом будь-коли.
13. Зміни до цих Умов
Ми можемо оновлювати ці Умови; дата «Останнє оновлення» відображає чинну версію. Про суттєві
зміни ми повідомлятимемо, коли це доцільно. Продовження користування після змін означає їх
прийняття.
14. Застосовне право
Ці Умови регулюються законодавством України, якщо не застосовується імперативне
законодавство про захист прав споживачів країни вашого проживання.
